TERMS AND CONDITIONS OF SALE
DEFINITIONS AND INTERPRETATIONS
Without having been defined beforehand, the terms used here beginning with a capital letter have the meaning indicated below:
“Customer” means a natural person who is at least 18 years of age, acting to satisfy personal needs, and who has full legal capacity to enter into an agreement under these terms and conditions.
“General Terms and Conditions of Sale for the Reserved Rate” refers to the specific terms and conditions applicable to each reservation made by the Customer.
“Booking Confirmation” means the document summarizing the details of the booking made by the Customer, sent to the Customer by the Website or the Hotel.
“Reservation Request” means any request by the Customer to reserve a hotel room.
“Partners” refers to all service providers that have entered into a service agreement or partnership agreement with the Hotel.
“Service” means any hotel room reservation service used by the Customer on the Hotel’s website.
“Hotel Website” refers to the website’s URL.
ARTICLE 1 - Scope of application
These General Terms and Conditions of Sale apply, without restriction or reservation, to all purchases of hotel room reservation services and related services (“the Services”) offered by the hotel owned by HK Lafayette – registered in Paris under SIREN number 333 353 787 – 20, rue de Trévise, 75009 Paris, France – offered on the Hotel’s Website to non-professional customers (“Customers”).
The main features of the Services are described on the Hotel’s website. Guests are encouraged to review them before making a reservation.
The Customer hereby declares:
- Have full legal capacity to enter into a contract;
- Reserve for personal use;
- You can save and print these Terms and Conditions.
Any reservation implies full and unconditional acceptance of these Terms and Conditions, the terms of the booked rate, and the terms and conditions of any partners.
Unless proven otherwise, the data recorded by the Hotel’s computer systems shall constitute proof of the transactions entered into. The entry of bank details and acceptance of the Terms and Conditions shall be deemed a signature.
Contract documents are retained for a maximum of 5 years.
The Customer is informed that their IP address is recorded at the time of booking.
These Terms and Conditions may be modified at any time. The applicable version is the one in effect on the date of booking.
The Hotel reserves the right to suspend or terminate access to its website.
ARTICLE 2 - Reservations
The Customer selects the room type and rate, reviews the details and total price, enters their contact information, provides their payment details, and confirms their reservation after accepting the Terms and Conditions.
The sale is final upon confirmation by email and, if applicable, receipt of payment.
Each reservation is non-transferable and must be made in the guest's name.
Cancellation – Flexible Rate
Any cancellation made after 12:00 p.m. on the day before arrival will result in a charge for one night.
Cancellation – Non-cancellable / Non-refundable rate
Any cancellation, change, or no-show will result in a charge for 100% of the stay.
ARTICLE 3 - Rates
Prices are listed in euros, including VAT, excluding the visitor's tax.
The visitor's tax is payable on site.
Additional services are not included unless otherwise stated.
ARTICLE 4 - Terms of payment
Payments are processed by HK Lafayette through a secure payment provider.
Non-refundable rate
Full payment is required at the time of booking.
Flexible pricing
Payment is due at the hotel upon arrival or departure.
A pre-authorization may be requested as a security deposit.
Payments are secured using SSL.
ARTICLE 5 – Provision of Services
The room is available from 3:00 p.m. and must be vacated by 12:00 p.m.
You may be asked to show identification upon arrival.
The hotel is non-smoking. Pets are not allowed.
The Customer is liable for any damage caused. Repair costs will be billed.
Wi-Fi access may be provided. The Customer is liable for any unauthorized use.
If the reserved room is unavailable, the hotel may offer an alternative accommodation of equivalent category.
Any complaints must be filed within 8 days of departure.
ARTICLE 6 - Right of withdrawal
In accordance with Article L.221-28 of the Consumer Code, accommodation services are not subject to the right of withdrawal.
ARTICLE 7 – Liability
The Hotel is responsible for the proper performance of its services in accordance with the provisions of French law.
ARTICLE 8 - Data protection
Personal information is required to process reservations.
The Customer has the right to access, correct, and object to the processing of their personal data in accordance with the GDPR.
ARTICLE 9 - Intellectual property
The content of this website is protected by intellectual property law. Any reproduction is prohibited.
ARTICLE 10 – Unforeseeability
The parties waive their right to invoke the unforeseeability provision set forth in Article 1195 of the Civil Code.
ARTICLE 11 - Force majeure
Neither party shall be held liable in the event of force majeure as defined in Article 1218 of the Civil Code.
ARTICLE 12 – Miscellaneous Provisions
The Terms and Conditions, the booking confirmation, and the pricing terms constitute the entire agreement.
The invalidity of any provision shall not affect the validity of the other provisions.
ARTICLE 13 – Governing Law
These Terms and Conditions are governed by French law.
ARTICLE 14 - Disputes
In the event of a dispute, the French courts shall have jurisdiction.
The Customer may seek the assistance of a consumer mediator in accordance with applicable regulations.
ARTICLE 15 – Pre-contractual Information
The Customer acknowledges having received, prior to making the reservation, all the information required under Article L.221-5 of the French Consumer Code (essential characteristics, price, identity of the business, payment terms, etc.).
By making a reservation, you fully and unconditionally agree to these Terms and Conditions of Sale and agree to pay for the services reserved.
